A complete brief speeds turnaround and improves report quality. ⭐ items are essential; ☐ items are strongly recommended where applicable.

1. Letter of Instruction

  • Matter type clearly identified — SIRA WPI, PIC referral, common law, TPD, medical negligence, fitness for work, Defence, etc.
  • Specific questions you want answered — see the focused-brief examples on the For Solicitors page
  • Acknowledgement of Expert Witness duty (Schedule 7 UCPR NSW) where the report is for court use
  • Relevant legislation / rules under which the assessment is conducted e.g. SIRA Permanent Impairment Guidelines edition, PIC procedural rules, MAI Act
  • Role of the report — primary opinion / addendum to prior / response to opposing expert / supplementary
  • Reporting deadline if any
  • Confirmation of acceptance of fees (quote provided on receipt)

2. Medical & Treatment Records

  • GP records relevant to the matter — full history, not just summary letters
  • Hospital admission summaries and discharge letters
  • Specialist correspondence — particularly any neurologist, neurosurgeon, pain physician, psychiatrist
  • Imaging reports — MRI, CT, X-ray (and the actual studies on disc/cloud link if available for independent review)
  • Neurophysiology reports — nerve conduction studies, EMG, EEG where relevant
  • Neuropsychological assessment reports
  • Physiotherapy, occupational therapy, psychology notes
  • Medication list — current and historical with dates

3. Legal & Background Materials

  • Statement of claim or index to court documents (where relevant)
  • Plaintiff's own statement — how the injury happened, evolution of symptoms, current impact
  • Prior medicolegal reports — both supporting and opposing
  • Police report / event timeline (motor accident / personal injury)
  • Witness statements relevant to the index event
  • Surveillance material if it is to form part of the opinion

4. Work / Disability Materials (where applicable)

  • Employer position description for pre-injury role
  • Work capacity certificates and return-to-work history
  • Pay slips / employment continuity records (loss-of-earning capacity assessment)
  • For TPD: full policy wording including the disability definition being relied upon
  • For fitness for work: defined duties, equipment used, safety-critical elements
  • For Defence: ADF medical and operational records, MEC requirements

5. Logistics

  • Client's name, date of birth, contact phone and email for appointment confirmation
  • Interpreter required? Language?
  • Mobility / accessibility needs (wheelchair, support person)
  • Preferred examination location (Bondi Junction rooms; telehealth in selected matters by prior arrangement)
  • Any safety considerations (history of aggression, prior incident at examination)

Matter-Specific Items

Additional items beyond the general checklist that are useful for specific matter types.

SIRA WPI / Workers Compensation

  • Identify the SIRA Permanent Impairment Guidelines edition (currently 4th for motor accident; AMA Guides 5th for workers comp neurology)
  • Confirm maximum medical improvement (MMI) has been reached — premature WPI is not valid
  • Provide any prior WPI assessments
  • Surveillance material (where relevant)

PIC Medical Assessment

  • PIC referral document including specific question(s)
  • Compliance with PIC procedural rules and timeframes
  • Identification of any prior PIC assessment

Common Law / Negligence

  • Expert Witness declaration explicitly requested
  • Statement of claim and defence (or summary)
  • Letters from opposing experts that you may want responded to

TPD / Superannuation

  • Full policy wording — particularly the disability definition being relied upon (often the difference between own-occupation, any-occupation, and ADL definitions matters significantly)
  • Date of disability onset / last day worked
  • Continuous disability period being claimed

Medical Negligence

  • Indication of which clinician's conduct is being assessed
  • Standard of care question framed (negligence vs causation vs damages)
  • Relevant guidelines or position statements where applicable

Fitness for Work / Driving

  • Detailed role description with safety-critical elements identified
  • For driving: Austroads Assessing Fitness to Drive class and concerns (commercial vs private)
  • Risk tolerance of the regulator/employer (where known)
